Jestli\u017ee cht\u011bj\u00ed ob\u010dan\u00e9 t\u0159et\u00edch zem\u00ed v \u010cesku leg\u00e1ln\u011b pracovat, m\u011bli by m\u00edt zaji\u0161t\u011bno pracovn\u00ed povolen\u00ed pro cizince, a to ve form\u011b tzv. zam\u011bstnaneck\u00e9 karty. Ta nahradila v\u00edzum pro cizince, kter\u00e9 bylo ur\u010deno jako\u017eto povolen\u00ed k pobytu nad 90 dn\u016f za \u00fa\u010delem zam\u011bstn\u00e1n\u00ed, povolen\u00ed k dlouhodob\u00e9mu pobytu za \u00fa\u010delem zam\u011bstn\u00e1n\u00ed a zelenou kartu.  Evropsk\u00e1 komise definuje pr\u00e1ci na\u010derno jako \u010dinnost, kter\u00e1 nebyla ohl\u00e1\u0161ena p\u0159\u00edslu\u0161n\u00fdm ve\u0159ejn\u00fdm \u00fa\u0159ad\u016fm. Jedn\u00e1 se o jeden z typick\u00fdch projev\u016f tzv. \u0161ed\u00e9 ekonomiky. Aktu\u00e1ln\u00ed odhady hovo\u0159\u00ed o tom, \u017ee velikost tzv. st\u00ednov\u00e9 ekonomiky \u010din\u00ed cca 10 % \u010desk\u00e9ho hrub\u00e9ho dom\u00e1c\u00edho produktu.  Pro\u010d je pr\u00e1ce na\u010derno tolik roz\u0161\u00ed\u0159en\u00e1 Zd\u00e1nliv\u011b p\u016fsob\u00ed takov\u00e9 zam\u011bstn\u00e1n\u00ed jako l\u00e1kav\u00e1 nab\u00eddka: Zam\u011bstnanc\u016fm b\u00fdv\u00e1 p\u0159isl\u00edben vy\u0161\u0161\u00ed v\u00fdd\u011blek, pen\u00edze tzv. na ruku, mo\u017enost v\u00fdplaty n\u011bkdy i \u010dast\u011bji ne\u017e jednou za m\u011bs\u00edc. Zejm\u00e9na vy\u0161\u0161\u00ed v\u00fdd\u011blek m\u016f\u017ee b\u00fdt re\u00e1ln\u00fd, nebo\u0165 zam\u011bstnavatel neodvede povinn\u00e9 odvody a m\u016f\u017ee tedy doty\u010dn\u00e9 pen\u00edze d\u00e1t zam\u011bstnanci. Ov\u0161em pozor, bez ofici\u00e1ln\u00ed pracovn\u00ed smlouvy nem\u00e1 zam\u011bstnanec nikdy jistotu, \u017ee se sv\u00fdch pen\u011bz skute\u010dn\u011b do\u010dk\u00e1. K zam\u011bstn\u00e1v\u00e1n\u00ed pracovn\u00edk\u016f na\u010derno se firmy uchyluj\u00ed tedy p\u0159edev\u0161\u00edm proto, \u017ee u\u0161et\u0159\u00ed. Z\u00e1rove\u0148 jim to v p\u0159\u00edpad\u011b cizinc\u016f usnadn\u00ed nezbytnou administrativu a zjednodu\u0161\u00ed slo\u017eit\u00fd n\u00e1bor. Odpad\u00e1 vy\u0159izov\u00e1n\u00ed ve\u0161ker\u00fdch povolen\u00ed. A to i p\u0159esto, \u017ee v tuzemsku se sna\u017e\u00ed n\u00e1bor uleh\u010dit programy pro ekonomickou migraci, kter\u00e9 odstartovaly v roce 2015 Pilotn\u00edm projektem Ukrajina a navazuj\u00edc\u00edm Re\u017eimem Ukrajina.   Pro\u010d se pracovat na\u010derno nevyplat\u00ed V prvn\u00ed \u0159ad\u011b se takov\u00fd typ pr\u00e1ce jednozna\u010dn\u011b nevyplat\u00ed samotn\u00e9mu zam\u011bstnanci: Nem\u00e1 za t\u00e9to situace n\u00e1rok na dovolenou, podstatn\u00e1 je i absence soci\u00e1ln\u00edho a zdravotn\u00edho poji\u0161t\u011bn\u00ed. Zam\u011bstnanec nen\u00ed ani chr\u00e1n\u011bn dvoum\u011bs\u00ed\u010dn\u00ed v\u00fdpov\u011bdn\u00ed lh\u016ftou, pakli\u017ee o pr\u00e1ci p\u0159ijde a nedostane odstupn\u00e9. Zvl\u00e1\u0161tn\u00ed riziko vyvst\u00e1v\u00e1 i v p\u0159\u00edpad\u011b potenci\u00e1ln\u00edho pracovn\u00edho \u00farazu. U \u0159\u00e1dn\u00fdch zam\u011bstnanc\u016f nese zam\u011bstnavatel zodpov\u011bdnost za \u00farazov\u00e9 poji\u0161t\u011bn\u00ed. V p\u0159\u00edpad\u011b zam\u011bstnanc\u016f, kte\u0159\u00ed pro n\u011bj pracuj\u00ed na\u010derno, v\u0161ak \u017e\u00e1dn\u00e1 podobn\u00e1 ochrana neexistuje. Probl\u00e9m samoz\u0159ejm\u011b nast\u00e1v\u00e1 tak\u00e9 za p\u0159edpokladu, \u017ee se na neleg\u00e1ln\u00ed zam\u011bstn\u00e1v\u00e1n\u00ed p\u0159ijde p\u0159i kontrole. Sankce hroz\u00ed zam\u011bstnanci i zam\u011bstnavateli. Zam\u011bstnavateli m\u016f\u017ee b\u00fdt vym\u011b\u0159ena sankce ve v\u00fd\u0161i a\u017e 10 milion\u016f korun. Doty\u010dn\u00e9mu pracovn\u00edkovi hroz\u00ed pokuta rovn\u011b\u017e, a to a\u017e ve v\u00fd\u0161i 100 tis\u00edc korun. Nepom\u016f\u017ee ani snaha se pokut\u011b jakkoli vyh\u00fdbat, nap\u0159\u00edklad zaml\u010den\u00edm identity.
